These Terms of Service (“Terms”) govern your access to and use of the SurveyPulse.ai platform, website, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

If you are using SurveyPulse.ai on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

1. About SurveyPulse.ai

SurveyPulse.ai provides AI-powered voice and text survey software that enables businesses to collect, analyze, and act on customer feedback. We act as a technology provider and data processor for feedback collected by our customers.

2. Your Responsibilities

You are responsible for:

  • Ensuring you have the right to collect and process customer feedback

  • Providing required notices and obtaining consent from end users where required by law

  • Using the Service in compliance with applicable privacy, data protection, and telecommunications laws

You must not use the Service to:

  • Collect data without lawful consent

  • Conduct illegal, deceptive, or harmful activities

  • Transmit malware, spam, or abusive content

3. Data Ownership

You retain full ownership of all customer data, survey responses, and feedback collected through the Service.

SurveyPulse.ai does not claim ownership of your data. We process data only to provide and improve the Service in accordance with our Privacy Policy.

4. Data Processing and Hosting

SurveyPulse.ai processes data on behalf of customers and stores data using secure cloud infrastructure (including AWS). We implement reasonable technical and organizational safeguards to protect customer data from unauthorized access or loss.

5. Service Availability

We aim to provide reliable and continuous access to the Service, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, upgrades, or temporary outages when required.

6. Fees and Payment

Pricing, billing terms, and payment schedules are defined in your commercial agreement or invoice with SurveyPulse.ai. Failure to pay may result in suspension or termination of service.

7. Intellectual Property

All software, technology, designs, branding, and content used in SurveyPulse.ai are owned by or licensed to us. You may not copy, resell, reverse engineer, or reproduce the Service without written permission.

8. Termination

We may suspend or terminate access if:

  • These Terms are violated

  • The Service is used unlawfully

  • Payment obligations are not met

You may terminate your account by contacting us.

9. Limitation of Liability

SurveyPulse.ai is not liable for:

  • Business losses

  • Loss of profits, data, or reputation

  • Customer disputes or misuse of feedback data

Our total liability is limited to the amount paid by you in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of Singapore or Malaysia (depending on contracting entity), without regard to conflict-of-law rules.
